They didn't when they started the site, and I can understand why they didn't since they couldn't get ahold of me. After I found the site, quite by accident, I checked into copyright infringement, and yes, the site did infringe. There were three ways to go. I could contact the U.S. Department of Commerce and have them contact the Department that would be reponsible for copyright in Italy and shut the site down. I could demand some sort of royalty payment for use of the game. Or, the third choice, and the one I chose, was to give permission to use the game.
Now, I see that WS&IM is still on the site. I don't know if the owners have permisssion from Hasbro to use the game. I do know that Hasbro protects its copyright with the full force of the law. WS&IM is still the property of Avalon Hill which is owned by Hasbro. If the site owners haven't gotten permission to publish the game online, they could find themselves in trouble with international copyright laws. On the other hand, Hasbro would have to find out about it and I doubt that they patrol the net to look for electronic copyright problems. Remember that no matter whether a game or book is still in publication, the copyright expires after the life of the owner plus 70 years, or 95 years or 120 years after publication. Something to think about.
Now as for the new a/c. The argument that they constitute a "house rule" is a good one. I personally play with 1/72nd scale a/c when I can find anyone interested in a game, and they aren't painted to resemble the a/c in the box. They are painted historically however. I suppose you can ask yourself whether or not you would take one of the the unhistorical a/c and paint it up in 1/72nd scale and take it to a convention to play Blue Max. I would prefer to see historical a/c only, and some of the new a/c are really well done. This is a little wishy-washy on the subject as I really don't like to tell people what they can and can't do. I do remember that we had intended to put Snoopy and his doghouse in the counter mix but couldn't get permission from Charles Schultz. If there is such a counter in the mix on this site, I would request that it be removed. The copyright on Peanuts is still very much alive and I would not want to have to explain that there was no such counter in the mix.
