The tailing bonus is given if you are in the right position and you can tail.
If you don't wait for your opponent's direction, you are losing informations, and this is already a malus you suffer (decided to take indeed). But if you manage to shoot to him, even without that information, I don't see anything wrong in getting the +1 bonus, as it was just more difficult to you to obtain that.
I understand that in RL Blue Max or thinking about the situation the game is simulating (plane combat) you are right, but we already know that this on-line transposition of this game has (and has to have) some semplifications, and this one doesn't seems to me a big matter.
